General Terms and Conditions of De Sjop Online

General provisions

Article 1 - Definitions

For the purposes of these general terms and conditions, the terms below are defined as follows:

  • Buyer: A customer who has explicitly declared that the purchased goods will not be used for criminal acts as defined in the law, in accordance with the amendment of the law of 1 March 2015.
  • The Shop Online: The webshop of De Sjop, located at Hurksestraat 64, Eindhoven, user of these general terms and conditions.
  • Agreement: Any agreement between the Buyer and De Sjop Online regarding the purchase and sale of products that De Sjop Online offers in the context of its normal business operations.
  • Conditions: The general terms and conditions of sale and delivery of De Sjop Online.

Article 2 – Applicability of the Terms and Conditions

These Conditions apply to every offer, quotation and agreement between De Sjop Online and the Buyer. Deviating conditions of the Buyer, such as purchasing conditions, only apply if they have been expressly agreed in writing with De Sjop Online.

If the Terms and Conditions are changed, the new Terms and Conditions will form part of each agreement unless the Buyer indicates in writing within seven days that he or she does not agree to the changes.

Artikel 3 – Totstandkoming van de Overeenkomst

Quotations and offers from De Sjop Online are without obligation, unless stated otherwise. An agreement is concluded when De Sjop Online accepts an order from the Buyer. If De Sjop Online does not refuse the order within two weeks, it is deemed to have been accepted.

The Buyer has the right to terminate the agreement without giving any reason within five working days after the order. This must be done in writing via e-mail.

Article 4 - Force majeure

In case of force majeure, De Sjop Online is not obliged to fulfil its delivery obligations. This includes situations outside the sphere of influence of De Sjop Online. The Buyer may terminate the agreement if it appears that fulfilment is not possible within two months.

Article 5 - Liability

De Sjop Online is not liable for any damage suffered by the Buyer or third parties as a result of defects in the delivered products or by not (timely) delivering. The liability of De Sjop Online is limited to the amount of the transaction in question.

Article 6 - Payment

Payments must be made to a bank account specified by De Sjop Online, within the term stated on the invoice. In case of late payment, De Sjop Online is entitled to charge interest and collection costs. De Sjop Online reserves the right to suspend deliveries in case of non-payment.

Article 7 - Retention of title

The delivered products remain the property of De Sjop Online until the Buyer has fully met his payment obligations.

Article 8 - Warranty

All products are covered by the manufacturer's warranties. Light sources can only be returned if unused and in their original packaging. De Sjop Online is not liable for consequential damage, unless there is gross negligence.

Article 9 - Delivery

Deliveries are discreetly packaged and usually handled by PostNL. De Sjop Online strives for a delivery time of maximum 15 working days within the Netherlands and Belgium. Additional costs for special requests from the Buyer will be charged separately.

Article 10 – Right to Complain and Returns

Complaints about delivered products must be reported within eight working days after receipt. In case of a justified complaint, products can be returned free of charge. The Buyer must follow the instructions of De Sjop Online and return the products properly packaged.

Article 11 – Risks

The risk of loss, theft or depreciation lies with De Sjop Online until the moment of delivery, after which the risk lies with the Buyer.

Article 12 – Applicable Law

Every agreement is exclusively subject to Dutch law. Disputes will be submitted to the competent court in 's-Hertogenbosch. De Sjop Online is based on the Dutch tolerance policy regarding cannabis and cannabis seeds and cannot be held liable for differences in regulations in other countries.

Article 13 – Privacy Statement

De Sjop Online only collects data that is necessary for the execution of orders and the fulfillment of obligations. Personal data is not provided to third parties, except for customer reviews via Kiyoh and for dropshipping via suppliers. Data is destroyed after completion of the order, except for accounting obligations.

Article 14 – Disclaimer

De Sjop Online strives for complete and correct information on its website, but accepts no liability for errors or omissions. Links to external websites are outside our responsibility, as well as any damage resulting from them.
